Licensing in Idaho

Money transmitter license from the Idaho Department of Finance under the Idaho Money Transmitters Act (Idaho Code 26-29). The statute does not mention virtual currency. Department guidance says a virtual currency exchanger that accepts fiat 'for later delivery to a third party' in connection with a crypto purchase must be licensed. This is guidance, not statute.

Kiosk-specific rules

Idaho has no law written specifically for crypto ATMs as of 2026-10-28. The general money transmission rules above and the federal rules still apply.

Bills and changes to watch

  • S1359a (2026), the Virtual Currency Kiosk Fraud Prevention Act, passed the Legislature and was VETOED by Gov. Little. His letter cites 'critical drafting deficiencies' and asks for tighter definitions, clear enforcement standards and a realistic implementation framework. Veto date unconfirmed.
  • H0646 and S1333 (2026), earlier versions of the Virtual Currency Kiosk Fraud Prevention Act, were not enacted.

Practical hurdles

  • Whether a kiosk needs a license turns on Department of Finance guidance, not statute. Operators should confirm with the Department.
  • A revised kiosk bill is likely in 2027, since the governor vetoed over drafting rather than policy.

What we couldn't confirm

  • Veto date and the substance of S1359a (caps, refunds). we didn't open the bill text or the veto letter.
  • Final status of H0646 and S1333 (presumably died in committee).
  • No enforcement actions or local bans were found.
