Licensing in Florida
Florida's money services business law (Fla. Stat. ch. 560) is administered by the Office of Financial Regulation (OFR), and money transmitter licenses go through NMLS. The 2026 kiosk law (CS/HB 505, Ch. 2026-178) makes a 'virtual currency kiosk business' a separate kind of money services business that must register with OFR, effective 2027-01-01. Licensed money transmitters are exempt from that registration but still subject to the kiosk rules.

Florida's kiosk law
Fla. Stat. 560.501-560.507 (HB 505, 2026) · effective 2027-01-01
- A virtual currency kiosk business must register with OFR before operating, unless it is a licensed money transmitter.
- Before a transaction, the kiosk must ask whether the customer has already transacted at another kiosk that day, and how much, so the daily limit can be applied.
- The kiosk must display this warning on screen: 'WARNING: FRAUD OFTEN STARTS WITH CONTACT FROM A STRANGER. IF YOU HAVE BEEN DIRECTED TO THIS MACHINE BY SOMEONE CLAIMING TO BE A GOVERNMENT AGENT, BILL COLLECTOR, LAW ENFORCEMENT OFFICER, OR ANYONE YOU DO NOT KNOW PERSONALLY, STOP THIS TRANSACTION IMMEDIATELY AND CONTACT YOUR FINANCIAL ADVISOR OR LOCAL LAW ENFORCEMENT.'
- A new customer may transact no more than $2,000 a calendar day, and an existing customer no more than $10,000, across one or more kiosks.
- The customer must be offered a physical or electronic receipt showing the business's email and toll-free number, date, time, USD amount, transaction hash and wallets, total fee, exchange rate, liability statement and refund policy.
- The business must give a full refund within 72 hours for a customer's first transaction if, within 60 days, the customer notifies the business and a law-enforcement or government agency of the fraud and provides proof such as a police report or notarized affidavit.

Practical hurdles
- From 2027-01-01, an operator that does not hold a money transmitter license must register with OFR as a virtual currency kiosk business.
- There is no statutory fee cap, but the refund duty for first transactions and the cross-kiosk daily limit attestation affect operations.
What we couldn't confirm
- We didn't read the enrolled text of CS/HB 505 itself. The rules above come from the Senate amendment to HB 505 and the matching CS/CS/SB 198, and a later Senate analysis that summarizes the enacted law.
- Whether the earlier draft condition that the crypto went to a wallet outside the US survived for refunds. It is absent from the amendment to HB 505 and from SB 198 c2.
- What CS/CS/HB 1087 (Ch. 2026-130), listed alongside as a companion, contributes.
- Exceptions to the 2027-01-01 effective date ('except as otherwise expressly provided').
- No kiosk-specific AG or OFR enforcement and no local bans were found.
