Licensing in Delaware
License from the Office of the State Bank Commissioner. Title 5, Chapter 23 of the Delaware Code is now 'Money Transmission and Virtual Currency' (85 Del. Laws c. 338). It is an MTMA-style rewrite with a Virtual Currency subchapter (VIII) that covers exchanging money for virtual currency, and it uses NMLS. Its transition section exempts existing licensees from new requirements until they renew or until 2027-07-07, whichever is later.

Kiosk-specific rules
Delaware has no law written specifically for crypto ATMs as of 2026-10-28. The general money transmission rules above and the federal rules still apply.
Bills and changes to watch
- HB 441 (153rd General Assembly) would ban crypto kiosks statewide. A violation would be an unlawful practice under consumer protection law, and operators would have to refund fees on illegal transactions within 30 days. The House Economic Development committee released it on 2026-06-09. A Delaware Public Media report on 2026-07-31 says the effort stalled. The session recessed 2026-06-30, and we found no record of a floor vote.
Practical hurdles
- There is regulatory risk: the DOJ, State Police, the Bank Commissioner, AARP and the Bankers Association all back a statewide ban (HB 441), and a new General Assembly could bring it back in 2027.

What we couldn't confirm
- HB 441's final status (whether it got a House floor vote). The headline says 'stalls', but we couldn't open the article because the fetch budget ran out.
- Effective date of 85 Del. Laws c. 338. CSBS (August 2026) lists Delaware SB 18 as only introduced, effective the earlier of 2027-07-06 or final regulations, but the Delaware Code already shows the new chapter. Exact effective date is unconfirmed.

- No Delaware kiosk enforcement actions or local ordinances were found.
