Licensing in Oregon

The Oregon Money Transmitters Act (ORS 717.200-717.320) requires a license from the Division of Financial Regulation (DCBS). The Act's definition of 'money' includes a medium of exchange that 'represents value that substitutes for currency but that does not benefit from government regulation requiring acceptance... as legal tender' (ORS 717.200(10)(b)), which covers virtual currency. DFR has enforced this against unlicensed crypto platforms; for example, a consent order with Payward (Kraken) found its crypto buy/sell platform was money transmission under ORS 717.200(11). Civil penalty: up to $1,000 per violation or per day (ORS 717.900). No kiosk-specific statute exists; AARP Oregon calls kiosks 'currently unregulated'.

Kiosk-specific rules

Oregon has no law written specifically for crypto ATMs as of 2026-10-28. The general money transmission rules above and the federal rules still apply.

Bills and changes to watch

  • No Oregon kiosk bill was enacted in the 2025 or 2026 sessions (none found). Per Oregon Treasury's report of a financial empowerment meeting, AARP Oregon says a proposal to ban crypto kiosks will be introduced in the 2027 session.

Enforcement and lawsuits

  • A DCBS newsroom post titled 'settlement with crypto kiosk operator' exists. The operator, date and terms are unconfirmed because the page could not be opened.
  • The Oregon DOJ and DCBS have issued a consumer caution about cryptocurrency ATMs. Per an Oregon Treasury newsletter (Winter 2024), the state does not track how many kiosks operate.

Practical hurdles

  • AARP Oregon is campaigning for a statewide ban, with a bill planned for 2027. Expect regulatory risk on placements made now.

What we couldn't confirm

  • The DCBS kiosk-operator settlement: operator name, date, amounts.
  • Whether Oregon money transmitter licensing runs through NMLS, and the bond and net worth amounts.
  • The subject of HB 4026 (2026, Rep. Sosa, House Interim Committee on Commerce and Consumer Protection). Search could not tie it to kiosks.
  • No Oregon local kiosk ordinances were found.
